In short
ImmoConstat is a tool that helps you document rental handovers. You are responsible for the accuracy of what you record. The app is provided "as is" and does not constitute legal advice. Subscriptions renew until cancelled and are managed through the App Store or Google Play.
1. Acceptance
By downloading or using ImmoConstat ("the app"), provided by Julian Sainz Martinez, Switzerland ("we", "us"), you agree to these Terms of Use. If you do not agree, please do not use the app.
2. What the app does
ImmoConstat lets you create move-in / move-out and related inspection reports, attach photos and signatures, and export them as PDF documents. The app runs locally on your device and does not require an account.
3. Your responsibilities
- You are responsible for the accuracy, completeness, and lawful use of the information and images you enter.
- You must have the right to photograph the property and to record the people and signatures you include.
- You are responsible for keeping your device and any exported reports secure once they leave the app.
4. Not legal advice
ImmoConstat is a documentation tool. It does not provide legal advice and does not guarantee that a report will satisfy any particular legal, court, or tenancy-authority requirement. For legal questions, consult a qualified professional.
5. Purchases and subscriptions
- Single report: a one-time purchase that unlocks the final (non-watermarked) export of one specific report.
- Pro (monthly / yearly) and Agency (monthly): auto-renewing subscriptions that unlock unlimited final exports and, for Agency, the agency tools.
- Subscriptions renew automatically until you cancel. You can manage or cancel a subscription at any time in your App Store or Google Play account settings; access continues until the end of the paid period.
- All payments are processed by Apple or Google. Refunds are handled according to their respective policies.
- Prices are shown in the app and may vary by region and over time.
6. Intellectual property
The app and its content (excluding the reports and media you create) belong to us. We grant you a personal, non-exclusive, non-transferable licence to use the app. The reports and media you create are yours.
7. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that exported documents will be free of defects.
8. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the app. Nothing in these terms limits liability that cannot be limited under applicable Swiss law.
9. Changes
We may update these terms. The current version is always published on this page with its effective date. Continued use after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of Switzerland, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights in your country of residence.

2. Ce que fait l'application
ImmoConstat vous permet de créer des états des lieux d'entrée/de sortie et rapports d'inspection associés, d'y joindre des photos et des signatures, et de les exporter en PDF. L'application fonctionne localement sur votre appareil et ne nécessite pas de compte.
3. Vos responsabilités
- Vous êtes responsable de l'exactitude, de l'exhaustivité et de l'usage licite des informations et images que vous saisissez.
- Vous devez disposer du droit de photographier le bien et d'enregistrer les personnes et signatures que vous incluez.
- Vous êtes responsable de la sécurité de votre appareil et des rapports exportés une fois qu'ils quittent l'application.
4. Pas un conseil juridique
ImmoConstat est un outil de documentation. Elle ne fournit pas de conseil juridique et ne garantit pas qu'un rapport satisfasse une exigence légale, judiciaire ou d'une autorité de logement particulière. Pour des questions juridiques, consultez un professionnel qualifié.
5. Achats et abonnements
- Rapport unique : achat ponctuel qui débloque l'export final (sans filigrane) d'un rapport spécifique.
- Pro (mensuel / annuel) et Régie (mensuel) : abonnements à renouvellement automatique qui débloquent les exports finaux illimités et, pour Régie, les outils dédiés.
- Les abonnements se renouvellent automatiquement jusqu'à résiliation. Vous pouvez gérer ou résilier un abonnement à tout moment dans les réglages de votre compte App Store ou Google Play ; l'accès reste actif jusqu'à la fin de la période payée.
- Tous les paiements sont traités par Apple ou Google. Les remboursements sont gérés selon leurs politiques respectives.
- Les prix sont affichés dans l'application et peuvent varier selon la région et dans le temps.
6. Propriété intellectuelle
L'application et son contenu (hors rapports et médias que vous créez) nous appartiennent. Nous vous accordons une licence personnelle, non exclusive et non transférable d'utilisation de l'application. Les rapports et médias que vous créez vous appartiennent.
7. Exclusion de garanties
L'application est fournie « en l'état » et « selon disponibilité », sans garantie d'aucune sorte, dans toute la mesure permise par la loi. Nous ne garantissons pas que l'application sera ininterrompue, sans erreur, ni que les documents exportés seront exempts de défauts.
8. Limitation de responsabilité
Dans toute la mesure permise par le droit applicable, nous ne sommes pas responsables des dommages indirects, accessoires ou consécutifs, ni de toute perte de données, résultant de votre utilisation de l'application. Rien dans les présentes conditions ne limite une responsabilité qui ne peut être limitée selon le droit suisse applicable.
9. Modifications
Nous pouvons mettre à jour ces conditions. La version en vigueur est toujours publiée sur cette page avec sa date d'effet. Toute utilisation continue après une modification vaut acceptation des conditions mises à jour.
10. Droit applicable
Les présentes conditions sont régies par le droit suisse, sans égard aux règles de conflit de lois, et sous réserve des droits impératifs de protection des consommateurs de votre pays de résidence.

Die App wird „wie besehen" bereitgestellt und stellt keine Rechtsberatung dar. Abonnements verlängern sich bis zur Kündigung und werden über den App Store oder Google Play verwaltet.
1. Annahme
Mit dem Herunterladen oder Nutzen von ImmoConstat („die App"), bereitgestellt von Julian Sainz Martinez, Schweiz („wir"), stimmen Sie diesen Nutzungsbedingungen zu. Wenn Sie nicht einverstanden sind, nutzen Sie die App bitte nicht.
2. Was die App leistet
Mit ImmoConstat erstellen Sie Einzugs-/Auszugs- und zugehörige Abnahmeberichte, fügen Fotos und Unterschriften hinzu und exportieren sie als PDF. Die App läuft lokal auf Ihrem Gerät und benötigt kein Konto.
3. Ihre Verantwortung
- Sie sind für die Richtigkeit, Vollständigkeit und rechtmäßige Nutzung der von Ihnen eingegebenen Informationen und Bilder verantwortlich.
- Sie müssen berechtigt sein, das Objekt zu fotografieren und die von Ihnen erfassten Personen und Unterschriften aufzunehmen.
- Sie sind dafür verantwortlich, Ihr Gerät und exportierte Berichte zu schützen, sobald sie die App verlassen.
4. Keine Rechtsberatung
ImmoConstat ist ein Dokumentationswerkzeug. Sie bietet keine Rechtsberatung und garantiert nicht, dass ein Bericht eine bestimmte gesetzliche, gerichtliche oder behördliche Anforderung erfüllt. Bei rechtlichen Fragen wenden Sie sich an eine qualifizierte Fachperson.
5. Käufe und Abonnements
- Einzelbericht: einmaliger Kauf, der den finalen Export (ohne Wasserzeichen) eines bestimmten Berichts freischaltet.
- Pro (monatlich / jährlich) und Agentur (monatlich): automatisch verlängernde Abonnements, die unbegrenzte finale Exporte und – bei Agentur – die Agenturwerkzeuge freischalten.
- Abonnements verlängern sich automatisch bis zur Kündigung. Sie können ein Abonnement jederzeit in den Kontoeinstellungen des App Store oder Google Play verwalten oder kündigen; der Zugang bleibt bis zum Ende des bezahlten Zeitraums bestehen.
- Alle Zahlungen werden von Apple oder Google abgewickelt. Rückerstattungen erfolgen gemäß deren jeweiligen Richtlinien.
- Die Preise werden in der App angezeigt und können je nach Region und im Zeitverlauf variieren.
6. Geistiges Eigentum
Die App und ihre Inhalte (mit Ausnahme der von Ihnen erstellten Berichte und Medien) gehören uns. Wir gewähren Ihnen eine persönliche, nicht ausschließliche, nicht übertragbare Lizenz zur Nutzung der App. Die von Ihnen erstellten Berichte und Medien gehören Ihnen.
7. Gewährleistungsausschluss
Die App wird „wie besehen" und „wie verfügbar" bereitgestellt, ohne jegliche Gewährleistung, soweit gesetzlich zulässig. Wir gewährleisten nicht, dass die App unterbrechungs- oder fehlerfrei ist oder dass exportierte Dokumente mängelfrei sind.
8. Haftungsbeschränkung
Soweit nach geltendem Recht zulässig, haften wir nicht für indirekte, beiläufige oder Folgeschäden oder für Datenverluste, die aus Ihrer Nutzung der App entstehen. Nichts in diesen Bedingungen beschränkt eine Haftung, die nach geltendem Schweizer Recht nicht beschränkt werden kann.
9. Änderungen
Wir können diese Bedingungen aktualisieren. Die aktuelle Fassung wird stets mit ihrem Gültigkeitsdatum auf dieser Seite veröffentlicht. Die fortgesetzte Nutzung nach einer Änderung gilt als Annahme der aktualisierten Bedingungen.
10. Anwendbares Recht
Diese Bedingungen unterliegen dem Recht der Schweiz, ohne Rücksicht auf Kollisionsnormen, vorbehaltlich zwingender Verbraucherschutzrechte in Ihrem Wohnsitzland.

Scaricando o utilizzando ImmoConstat (« l'app »), fornita da Julian Sainz Martinez, Svizzera (« noi »), accetti i presenti termini d'uso. Se non sei d'accordo, ti preghiamo di non utilizzare l'app.
2. Cosa fa l'app
ImmoConstat ti permette di creare verbali di entrata/uscita e relativi rapporti di sopralluogo, allegare foto e firme ed esportarli come documenti PDF. L'app funziona localmente sul tuo dispositivo e non richiede un account.
3. Le tue responsabilità
- Sei responsabile dell'esattezza, della completezza e dell'uso lecito delle informazioni e immagini che inserisci.
- Devi avere il diritto di fotografare l'immobile e di registrare le persone e le firme che includi.
- Sei responsabile della sicurezza del tuo dispositivo e dei rapporti esportati una volta che lasciano l'app.
4. Non è consulenza legale
ImmoConstat è uno strumento di documentazione. Non fornisce consulenza legale e non garantisce che un rapporto soddisfi un determinato requisito legale, giudiziario o di un'autorità per le locazioni. Per questioni legali, consulta un professionista qualificato.
5. Acquisti e abbonamenti
- Rapporto singolo: acquisto una tantum che sblocca l'esportazione finale (senza filigrana) di un rapporto specifico.
- Pro (mensile / annuale) e Agenzia (mensile): abbonamenti a rinnovo automatico che sbloccano esportazioni finali illimitate e, per Agenzia, gli strumenti dedicati.
- Gli abbonamenti si rinnovano automaticamente fino all'annullamento. Puoi gestire o annullare un abbonamento in qualsiasi momento nelle impostazioni del tuo account App Store o Google Play; l'accesso continua fino alla fine del periodo pagato.
- Tutti i pagamenti sono gestiti da Apple o Google. I rimborsi sono gestiti secondo le rispettive politiche.
- I prezzi sono mostrati nell'app e possono variare per regione e nel tempo.
6. Proprietà intellettuale
L'app e i suoi contenuti (esclusi i rapporti e i media che crei) appartengono a noi. Ti concediamo una licenza personale, non esclusiva e non trasferibile per l'uso dell'app. I rapporti e i media che crei sono tuoi.
7. Esclusione di garanzie
L'app è fornita « così com'è » e « come disponibile », senza garanzie di alcun tipo, nella massima misura consentita dalla legge. Non garantiamo che l'app sia ininterrotta o priva di errori, né che i documenti esportati siano privi di difetti.

Nella massima misura consentita dalla legge applicabile, non siamo responsabili per danni indiretti, incidentali o consequenziali, né per qualsiasi perdita di dati, derivanti dall'uso dell'app. Nulla in questi termini limita una responsabilità che non può essere limitata ai sensi del diritto svizzero applicabile.
9. Modifiche
Possiamo aggiornare questi termini. La versione vigente è sempre pubblicata su questa pagina con la relativa data di efficacia. L'uso continuato dopo una modifica costituisce accettazione dei termini aggiornati.
10. Legge applicabile
I presenti termini sono regolati dal diritto svizzero, senza riguardo alle norme sui conflitti di legge, e fatti salvi i diritti imperativi di protezione dei consumatori del tuo paese di residenza.
